The donation Martin made was to be used to fund the new operation in Belize and the US. Martin did receive his tax credit and the funds did move as promised in ACES bank account.
The process was now defined. Jensen expressed concern about taking fees or commissions as Diana Sturm had done with her operation American Friends of Belize as the means to fund the operations. Jensen did his own research into this on the IRS web site and found this practise violated IRS regulations. Martin continued with the organization of the 501 (c) 3 as planned.
Be
Tension grew in 2009 between the parties involved. Jensen requested copies of the organization of the Corp and 501 (c) 3. Which to this date has never been supplied.
Jensen case with the Hospital in Belize was coming to a point of action was required by Bailey and Wyant's Jensen behalf.
Martin and Fioravante had gotten themselves into a land deal that Jensen had no involvement with.
Martin and Fioravante asked Jensen for $125,000 to bail them out of the problem which Martin and Fioravante were about to loose $25,000 deposit which was borrowed.
Jensen also asked the Rose for accounting of The Belize Economic & Ecological Development Fund and Adiforous Wines and Liquors.
Jensen had attorneys's in Belize the now Prime Minister Dean Barrow Law firm established the legal business entities which the Jensen's had operated in Central America a Caricom Corp. Jensen also had the Law firm of Fred Lumor represent his case with the Belize Hospital as it related to Janis lack of health care coverage. Both Law firms made attempt to collect information and to suggest Jensen course of action with Martin, Fioravante and the Rose's.
Jensen Law firms investigations came to the following conclusions.
-
Bailey and Wyant had submitted a number of documents claiming actions in the health care case. None of the filings had been completed yet claimed.
-
Martin had direct knowledge of Jensen net worth caused concern as both Law firms feeling Jensen was a victim. A widow, whom had been taken advantage of. Jensen had funded most of the events and the act by Martin and Fioravante demanding Jensen to make a loan of $125,000 followed the Law firms opinions.
-
The Roses refused all requests for accounting of activities related to Adiferous and the 501 (c) 3.
-
Martin refused to respond to any form of communications as it related to the claimed pending legal actions as it related Janis Health Coverage, the 501 (c) 3 and the responsibilities of the Bailey and Wyant as it related to Jensen and Janis will's trust and estate remaining in the US.
-
Martin as the US legal representative of the Jensen's had a 1% share in the Caricom Corp established by Dean Barrows office.
Following the advise of Jensen Attorney's, Jensen severed all ties with Bailey and Wyant, Martin, Fioravante and the Roses. Jensen had signed a Power of Attorney after Janis death which Martin continued to act on Jensen and Janis behalf without Jensen authorization.
Martin, Fioravante and the Roses continued to operate The Belize Economic & Ecological Development Fund and as stated on there web site promoting the 501 (c) 3 took a 10% fee on all donations received.
Jensen investment into the Adiferous Liquors ended with the Rose's selling off the inventory and keeping an inventory investment estimated at $25,000 US.
In 2010 the relationship between Martin, Fioravante ended in a violent domestic dispute.
Martin sold the Pink Motel in San Pedro in Belize in either late 2011 or early 2012 for $450.000 US kept the proceeds never returning Fioravante's initial investment.
The Rose's have amassed real-estate holding now estimated at around $500,000 US in Belize.
In January of 2013 Martin and the Rose's closed The Belize Economic & Ecological Development Fund feeling pressure from Jensen attorneys in Central America. Although Jensen was indicated in correspondence as a director and share holder of The Belize Economic & Ecological Development Fund Jensen was never consulted Martin had become the Assistant Prosecuting Attorney for Pocahontas County West Virginia.
In January of 2013 Martin filed a Civil action against a West Virginia Blogger claiming slander. In Affidavits filed in this case not related to Jensen both Martin and the founding partner of Bailey and Wyant Chuck Bailey stated for some reason that no relationships or knowledge existed with Martin and Belize yet reference Jensen name throughout the Affidavits. The blogger forwarded these Affidavits to Jensen. The blogger was seeking Martin's tax returns as part of the civil process. Which Martin has fought throughout the case.
Jensen had in the past made attempts through legal process to gain part of his losses by his business choices with these individuals. A complicated series of events. International case. Huge, established Law Firm in West Virginia, with connections to the Governors office.
Seeing that Martin was fighting to keep his tax records out of the courts in this Civil Case Jensen made the decision to have this group investigated by the IRS. Having intimate knowledge of the means the individuals operated Jensen prepared a summary sent to all divisions of the IRS. Jensen also has solicited an Law Firm in the US to act on Jensen behalf to assist in this process of dealing with the IRS.
It is Jensen opinion based on facts that Martin and the Rose's have failed to act on the IRS requirement of Voluntary disclosure. Have filed false tax returns and have operated a 501 (c) 3 as a for profit operation.
-
Jensen had access to Martin and the Rose's bank accounts.
-
Martin and the Rose owned and or own real-estate with a combined value of 1 million dollars.
-
Martin and Fioravante through a Belize banks account regularly had more then $10,000 on deposit. Jensen was a signer on this account.
-
Martin and Fioravante transferred large sums of fund through an off shore bank in San Pedro Belize called Caye Bank.
-
The Roses have amassed assets or $500,000 which have not been disclosed.
-
The Roses have a Civil action filed against Belize asking for over 950,000 Belize in Damages.
-
Martin and the Rose's operated a 501 (c) 3 outside the guidelines of the IRS.
The extend that these parties operate one must consider them dangerous. Martin and the Rose's distributed a poster at border crossing in Central America offering a bounty of $10,000 for Jensen. In November of 2012 the Rose's posted on a Facebook account Jensen's location in Guatemala. With the bounty offered for Jensen. Jensen had this site taken down.
